Неоднократное совершение на организованных торгах сделок в целях введения в заблуждение относительно цены объекта биржевой торговли. Заключение сделок, обязательства по которым исполняются за счет или в интересах одного лица. Как известно, договор – соглашение двух или нескольких лиц об установлении, изменении или прекращении гражданских прав и обязанностей (п. 1 ст. 420 Гражданского кодекса РФ, далее – ГК РФ). Когда заинтересованной стороной, например, при купле-продаже, является лишь одна сторона, то это совершение манипулятивных действий на организованных торгах посредством мнимых сделок, что согласно нормам гражданского права является основанием для прекращения обязательств (ст. 413 ГК РФ)1.

Сторонами по данному договору также могут быть организатор торговли и (или) клиент участника торгов. Если клиент участника торгов не является стороной данного договора, в нем должно быть указано, за счет какого клиента действует участник торгов. Она состоит из реальных и законных сделок, и единственным спорным элементом является намерение трейдера.
